1. Agreement to Terms

By accessing or using the website hmpbrands.com (the "Site") or purchasing products from HMP Brands ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site or place an order.

We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.

 

2. Eligibility & Age Restriction

You must be at least 18 years of age to purchase products from HMP Brands. By placing an order, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into a binding agreement;
• Your use of the Site and purchase of products complies with all applicable laws and regulations in your jurisdiction.

HMP Brands reserves the right to refuse service to anyone and to cancel orders we believe may violate applicable law, including age restrictions.

 

3. Products & Product Information

HMP Brands sells topical wellness products, including hemp-based formulations, muscle and joint creams, and related personal care items. Product descriptions, ingredient lists, and images are provided for informational purposes and are subject to change without notice.

We make every effort to display product colors and appearance accurately; however, we cannot guarantee that your device's display will accurately reflect the actual product.

We reserve the right to discontinue, modify, or limit the availability of any product at any time without notice.

State Availability

Due to varying state laws regarding hemp and hemp-derived products, certain products may not be available for shipment to all states. It is your responsibility to verify that the product you are ordering is legal in your state or jurisdiction. HMP Brands is not responsible for orders placed in violation of applicable state laws.

 

4. FDA Disclaimer & No Medical Claims

These statements have not been evaluated by the Food and Drug Administration. HMP Brands products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Products sold by HMP Brands are intended solely for topical external use as cosmetic or personal care products, unless otherwise indicated on the product label. Nothing on the Site, in product descriptions, or in any marketing materials should be construed as medical advice or as making any health claim beyond what is indicated on the applicable product label.

If you have a medical condition, are pregnant, nursing, or taking medications, consult a licensed healthcare professional before using our products.

 

5. Orders & Payment

By placing an order through the Site, you represent that you are authorized to use the payment method provided. All prices are listed in U.S. dollars. We reserve the right to change prices at any time.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or concerns about the validity of an order. If your order is cancelled after payment has been processed, we will issue a full refund.

Sales Tax

Sales tax will be collected where required by applicable law. The applicable tax will be displayed at checkout prior to the completion of your purchase.

 

6. Shipping & Delivery

HMP Brands ships to the contiguous United States and other locations as indicated on the Site at the time of purchase. Shipping timelines are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, or other circumstances beyond our control.

Title and risk of loss for products pass to you upon delivery to the carrier. If a package is lost or damaged in transit, please contact us promptly so we can assist with a carrier claim.

Shipping charges are non-refundable unless the return is the result of our error.

 

7. Returns & Refund Policy

We want you to be satisfied with your purchase. If you are not completely satisfied, please contact us within 30 days of the delivery date.

Eligible Returns

• Products must be returned in unused, unopened condition in original packaging.
• Opened or partially used products are not eligible for return due to the personal care nature of our products, unless there is a confirmed manufacturing defect.
• Products damaged due to misuse, improper application, or failure to follow label instructions are not eligible for refund.

Refund Process

To initiate a return, contact us at support@hmpbrands.com with your order number and reason for return. Approved returns must be shipped back at the customer's expense unless the return is due to our error or a confirmed product defect. Refunds will be issued to the original payment method within 5–10 business days of receipt and inspection of the returned product.

 

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of HMP Brands or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, or otherwise use any content from the Site without prior written permission from HMP Brands.

 

9. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to any portion of the Site or any related systems;
• Transmit any harmful, offensive, or disruptive content;
• Use automated means to scrape, crawl, or collect data from the Site;
• Resell products purchased from the Site without our express written consent.

 

10. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HMP Brands does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

 

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HMP BRANDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR PURCHASE EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless HMP Brands and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to your violation of these Terms, your use of the Site, or your purchase or misuse of our products.

 

13. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in our Privacy Policy.

 

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your purchase from HMP Brands shall be resolved by binding arbitration administered by the American Arbitration Association in Duval County, Florida, in accordance with its Consumer Arbitration Rules. You waive any right to a jury trial or to participate in a class action lawsuit.

Notwithstanding the foregoing, HMP Brands reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction.

 

15. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HMP Brands with respect to your use of the Site and purchase of products, and supersede all prior agreements and understandings.
